The new Spanish "Golden Visa Law" enables non-EU nationals to attain qualified residency permits in return for investing in Spanish real estate (and other assets) if certain conditions are fulfilled.

On the 27th of September 2013, the Spanish Government approved the Investor’s Residency Law, popularly known as the “Golden Visa Law”. This law 14/2013 introduces the conditions that have to be met by non-EU investors to qualify for Spanish residency.
That grants the right to reside in Spain and travel in Europe but not to work or gain benefits that the Spanish state offers.
The investor does not need to reside in Spain although his or her immediate family can reside in Spain and go to school and university.


General Requirements
• Not be in Spain in an irregular situation.
• Be over 18 years of age.
• Have no criminal record in Spain or in the countries where they have resided for the past five years.
• Not be subject to an alert issued for the purposes of refusing entry.
• Have a public or private health insurance policy with an insurance company authorised to operate in Spain.
• Have sufficient financial resources for themselves and for the members of their families during their residence in Spain.
• Have paid the visa or authorization processing fee.


Specific Requirements
In order to consider a capital investment as significant in order to apply for a residency permit to non-EU residents, one of the following criteria must be fulfilled:
• An initial investment equal or greater than €2.000.000 in Spanish public debt securities
• An initial investment equal or greater than €1.000.000 in company shares or stock of Spanish capital companies
• An initial investment equal or greater than €1.000.000 in investment funds, closed-end investment funds or venture capital funds constituted in Spain.
• The acquisition of real estate property in Spain with an investment value over €500.000.
• A business project intended to be carried out in Spain that is deemed and proved to be of general interest, because:
      1. The creation of jobs
      2. Making an investment with relevant socio-economic impact
      3. A relevant contribution to scientific and/or technological innovation.
